Immigration is out of control - you have
been lied to!
by Mike CraneThis is the first article in our new section
on the effects of immigration on our State of Georgia. I am sure that all
of you have heard the song and dance, immigrants only take the jobs that
Americans do not want. But have you accepted this piece of politically
correct hogwash or did it smell a little bit fishy to you?
If you did not buy it, then you were absolutely correct. It is true
that the excessive influx of both legal and illegal immigrants does have the
effect of lowering both employment levels and pay scales of American
citizens! It is false that excessive immigration is good for our country.
Before beginning let us state that our policy is not an
anti-immigrant policy. Virtually all of us are descendants of immigrants.
The issue is the rate of immigration. It is excessive and when illegal
immigration is taken into account, it can only be described as out of
control. At these rates, you , your family and grandchildren are
going to pay an enormous price, just to benefit the politically correct
and large corporations.
Of course the politically correct will whine and scream and call us
all kind of names. But then what do you expect from the idiots who bring
us searches of 80 year old grandmothers so that young Moslem males are not
offended!
Lets start with an immigration program commonly referred to as H1-B.
At this point quite a few will say that they have never heard of it.
This is the immigration program brought to us by mostly Republicans
as a plum given to their corporate sponsors. It is centered in the high
tech areas and allows high tech immigrants to come to our country by the
hundred thousands if they can get a corporate sponsorship.
As long as they maintain the sponsorship they are entitled to stay
here and work for their sponsor. If they lose their sponsor they will get
deported. Even though countless thousands of criminal immigrants can not
be found by INS, they find and deport H1-B immigrants that quit or lose
their sponsored jobs. Now isn't that strange?
With that picture in mind, think about how an unscrupulous
corporation could take advantage of such a situation. Bet it did not take
you long to figure that one out.
Americans get replaced by H1-B visa immigrants at an alarming rate.
Now lets go back to the story that you are told about immigration - they
do the jobs that Americans will not do. Well these are high paid,
technology jobs and your fellow citizens are being replaced so that
corporations can reduce their payrolls and run sweat shops. Now is that a
good thing?
In looking at the H1-B visa program and our State, its major effect
is in the Atlanta area. It is also interesting that the Atlanta area is
where there is strongest support for politicians that support excessive
immigration and the H1-B visa program. Some of these folks are not as
smart as they think they are. When they, a member of their family or a
friend become unemployed or under employed they can go look in a mirror
for the culprit!

Congress authorizes foreigners to
sponsor immigrants to the U.S.
Conventional wisdom holds that only U.S. citizens can
sponsor foreigners to come to America. Even then, such petitions are limited to
immediate family members and subject to substantial delays. Congress, however,
has provided a loophole that grants foreigners the authority to petition
family, friends, and associates to immediately migrate to the United States.
This loophole is the H-1B visa. The intent of the H-1B visa
was for the limited purpose of providing employers to ability to hire
foreigners when skilled workers were not available within the U.S. workforce.
But in practice this visa is used to import computer programmers and related
professionals for the purpose of excluding, displacing, or replacing qualified
American workers – or to circumvent immigration laws.

Current law provides for Americans to lose jobs while H-1Bs remain and continue to be hired
Sun Microsytems laid off about 4000 IT workers in
November 2001. Employees from across the country reported that Americans
were terminated while H-1Bs remained. In 2001 Sun had applied for over
5000 LCAs for H-1B workers. In spite of the evidence, the Justice
Department found that Sun had not violated any "discrimination" statute.
On the contrary, if Sun had chosen to first lay-off its temporary foreign
workers, it could have been convicted of "discrimination."
Since the H-1B was approved based on a labor shortage,
the failure to favor Americans over H-1Bs in a downturn is a gross
injustice and depravation to American workers. How is there an "IT
shortage" when thousands of Americans are being laid off?
|
Even as the stock market and dot-com economy were
retreating, in October 2000 Congress increased the H-1B quota to 195,000 per
year for three years while failing to provide any meaningful protections for
U.S. workers. Bank of America, for example, is laying off American IT workers,
while forcing them to train their foreign replacements as a condition of
receiving severance pay.[1]
Employers obtain H-1B workers by filing a Labor Condition
Application (LCA) stating vague requirements and salary range for the position
they wish to fill. If the form appears correct, INS rubber-stamps its approval.
Unless the employer is "H-1B dependent," they may hire a foreigner without
first recruiting for a U.S. worker. (Only about 50 out of 50,000 H-1B employers
are classified as H-1B dependent.) A small company of less than eight employees
is not considered H-1B dependent, even if all employees are H-1B immigrants.
If the employer is H-1B dependent, they must run a help
wanted ad and interview some token Americans prior to hiring their foreign
candidates. The Labor Department relies on the good faith of the employer to
determine whether the American candidates were qualified.
Is that reliance justified? In his 12/24/2002 commentary "A
crime against Americans," Rey David explains that, "it has become a common
practice for some Indians to set up dummy corporations, create dozens of bogus
job openings, sponsor H1-B visas for candidates in India and arrange a
temporary home for these ‘successful candidates.’"[2]
Moreover, Indian nationals who hold positions as hiring
managers — acting on behalf of major corporations that are exempt from the
requirement to recruit Americans first — have authority to select their fellow
nationals over Americans.
Once the H-1B visa is granted, the employer is authorized to
sponsor the employee for a green card, granting the permanent residency to
obtain citizenship.
Unemployment is endemic among U.S. computer programmers.
Employers report receiving hundreds of applicants for one opening, and 6000
candidates arrived for 200 positions at eBay.[3] A former Motorola
executive has sent 2000 resumes in the past year, resulting in one interview
and zero jobs.[4] Yet the fraud and displacement continues. In his
article "Legal Rejection of U.S. Workers,"[5] immigration attorney Joel
Stewart explains how, "Even in a depressed economy, employers who favor aliens
have an arsenal of legal means to reject all U.S. workers who apply."
How did such anti-American legislation pass? The India
association NASSCOM[6] claims to have worked "in close association with
…U.S. Congress to increase the H-1B visa cap."[7] The immigration law
firm of Carl Shusterman reports that H-1B workers themselves assisted in
drafting this federal legislation.[8]
The Congress and Senate are aware of the widespread fraud
and that at least 100,000 U.S. programmers have been displaced or replaced by
nonimmigrant foreigners. Yet, none will act to suspend the program — thus
authorizing another 195,000 H-1B visas in 2003, throwing a corresponding number
of highly skilled Americans out of work.
Knowingly destroying Americans’ careers while supporting the
interests of foreign countries, organizations, and workers is treason.
Legislation that allows foreign nationals to petition fellow foreigners for
immigration by excluding American workers is unconscionable.
Congress must suspend the fraudulent H-1B program
immediately. The 500,000 positions wrongfully held by foreign workers should be
reposted to provide jobs for unemployed Americans. Then new legislation should
be drafted which meets the needs of U.S. employers without becoming an
exploited immigration loophole.

Final comment: This is just the tip of
the iceberg. We started this section with H1-B visas just to show that the
issue has wider affect than you have been led to believe. From the very
passage of the "Immigration Act of 1965" until today you have been lied to
by self serving politicians, of BOTH major parties.
We will now start with the passage of the 1965 Act and you will be
absolutely shocked at what the real social, economic and cultural effects
of out of control immigration are on our State and Nation.
Nothing will change until - you - the citizens
demand that it be changed and then work to implement that demand.
